Everyone needs a good night’s sleep, however, if you are burdened by noisy neighbours, you may find it hard to relax in your own home. In the latest blog post by Broadbents Solicitors, we discuss regulations surrounding late night noise and potential steps you can take to remedy the situation.

Late night hours are considered to be between 11 pm and 7 am, and to reduce noise levels between these times, the law defines a maximum level of noise that is acceptable.

You may find that chatting with your neighbours about the noise level solves the issue. However, unfortunately, in some circumstances, you could find this makes the situation worse. If you find that your complaint escalates and ends up in court, initial mediation will demonstrate to the court that you have acted reasonably to solve the issue.

In many cases, you may find it difficult to prove that the noise levels made by your neighbour between the hours of 11:00 pm and 7:00 pm are unreasonable. Working alongside a solicitor will help you to properly prepare your case for the courtroom.

You may take your case to the magistrate’s court if – you don’t complain to the district council or the district council doesn’t do anything about your complaint.

You may believe that it is only in circumstances where noisy neighbours are intentionally causing disruptive noise that a complaint will resolve in compensation being awarded. However, you may also be awarded damages if it is found that appropriate measures have not been taken to limit the noise to your property. Further to any monies awarded, depending on the circumstances, the court may also rule that the offender(s) must put appropriate measures in place to avoid the situation occurring in the future.
